Conditions of Reservation

01. Rates are in USD, tax included, per night, based on the occupation and room type requested, with no discount available for individual services not consumed in the All Inclusive program.

02. Should you arrive with additional guests upon check in, not included in your original reservation, you will be charged for the additional guests and or any room changes necessary.

03. Extra guest rates may only be used in conjunction with 2 adult rates and must not exceed the maximum room occupancy of the category.

04. In the event of a late arrival or no shows with a confirmed reservation, Majestic Resorts reserves the right to charge a penalty of 100% of the value of the stay, except, fortuitous events or force majeure.

05. Cancellation policy. For travel on or after December 16, 2022 in the event of cancellation 14 days or less before arrival, the hotel reserves the right to charge a penalty of 100% of the value of the deposit made.

06. Child rates will be applicable for children ages 2-12 yrs, when sharing a room with 2 paying adult rates. One child sharing a room with one adult (single occupancy) will be charged an adult rate.

07. Changes to the All Inclusive program, daily activities, availability of facilities or any room changes, or as a result of government protocols or force majeure may be made at the discretion of management and no refunds will be applied during situations such as hurricanes, epidemics, natural catastrophes or other.

08. During the online reservation process, 20% of the amount will be paid, so you authorize the Hotel to make the charge to the card registered at the time of purchase. The holder of the card must be included in the reservation and present at the time of completing the registration process at the Hotel. The remaining 80% will be paid upon arrival at the hotel.

09. Check-in time 3:00 PM (1500 HRS) and Check-out time 12:00 PM (1200 HRS). A fee will apply for guests requesting late check-out. Courtesy showers are available in each lobby for the convenience of our guests, luggage storage is also available.

10. Please note, rooms accepting extra guests such as children or triple/quad occupancy, in some room categories may constitute additional bedding being brought into the room, which are subject to availability at the time of arrival.

11. The Hotel follows the existing legislation in terms of security and public liability. The Hotel won’t take responsibility of personal items or objects damaged, lost or left at the property.

12. In case of disagreement, dispute which may arise in the interpretation or fulfillment of the present contract both parties submit exclusively to the courts of Dominican Republic or Mexico.

  

  

  

PAYMENT TERMS POLICY

● A pre-authorization will be taken on your credit card under the name the booking is made for the total stay on your arrival. It is mandatory for guests to present valid government-issued photo identification at the time of check-in. Valid passports are required for international guests.

● Payment can be made using a credit card, including American Express, Mastercard, and Visa. Discover cards are not accepted as a form of payment at this time.

● Applicable taxes will be applied at the time of reservation.

● The owner of the credit card used to make the booking online must be present at check-in. If the owner is not present, the credit card will not be accepted.

● Guests are responsible for providing a valid form of payment during check-in that was used to make the booking online. The booking will be charged in full upon check-in.

● Any supplemental charges accrued during the guest's stay will be charged to the credit card provided at check-in and the guest will be responsible to sign for these charges upon check-out.

FULL PRIVACY NOTICE FOR MAJESTIC ELEGANCE COSTA MUJERES

In compliance with the Federal Law for the Protection of Personal Data in Possession of Individuals (the “Law”) and its Regulations (the “Regulations”), and also the Guidelines of the Privacy Notice published in the Official Federation Gazette on 17 January 2013 (the “Guidelines”), in force in the United Mexican States (“Mexico”); Alsteran, S.A. de C.V., whose address is Hotel Majestic Elegance Costa Mujeres, located on Carretera Libre 85 Punta Sam - Isla Blanca, supermanzana 006, manzana 2, lote 1, sublote 3, Isla Mujeres, Quintana Roo, Mexico (hereinafter, “Majestic Elegance”), which is responsible for the processing and protection of Personal Data (as defined below) hereby informs you of its Privacy Notice.

For any information or clarification relative to the content of this Privacy Notice, you should contact Majestic Elegance’s Department in charge of the Processing and Protection of Personal Data (hereinafter, the “Personal Data Protection Department”) whose address is as indicated above in the immediately preceding paragraph, at any time, by email addressed to lfpd.mecm@majestic-resorts.com.

Where no express provision is made in this Privacy Notice the terms set out in the current Law, the Regulations and the Guidelines will apply.

I. Information Requested.

The personal details that Majestic Elegance might ask you for are: name, date of birth, civil status, private and/or work address, telephone numbers, email, Federal Taxpayers Register password (“RFC”), credit card number to which the services and/or products ordered will be charged. Majestic Elegance might also ask you for copies of the official documents containing the information submitted such as a copy of an official identity document with a photo, the credit card provided and RFC (hereinafter all of the above will be referred to as the “Personal Data”).

If the Personal Data refers to minors, persons declared incompetent or incapacitated under applicable law, the processing of their data will require consent from their parents or guardians. Any exercising of the rights of the data subject must take place through the person holding parental authority or guardianship or representation of the incapacitated person, as the case may be.

Any documentation and information collected by us to that effect will be kept with the security, administrative, technical and physical measures as necessary for protecting your Personal Data.

The collecting and processing of Personal Data complies with the principles of legality, quality, consent, information, purpose, loyalty, proportionality and responsibility established in legislation applicable in the United Mexican States. Personal Data is collected in good faith, whereby Majestic Elegance takes no responsibility for its accuracy.

II. Purpose of the Processing.

Your Personal Data is obtained in order to:

(i) Carry out the registration and confirmation of your reservation of the services and products requested.
(ii) Provide you with the services and/or products requested.
(iii) Pay for the services and/or products requested, to be charged against the credit card provided.
(iv) Identify customers or potential customers.
(v) Inform you about changes and/or any other relevant information.
(vi) Invoicing.
(vii) Comply with the contracts entered into with you.

And also:

(a) Evaluate the quality of the services provided.
(b) Keep our databases updated.
(c) Send you information for the purpose of marketing, advertising or commercial research.
(d) Carry out surveys at any time; and
Contact you personally by telephone or email for all the purposes listed above.

III. Video Surveillance.

For the safety of the Hotel Majestic Elegance, its users, visitors and employees, security cameras have been placed in the [corridors, restaurants, lobby, public common areas of the hotel], so you are hereby informed that once you enter the Hotel Majestic Elegance you will be recorded by the Majestic Elegance security cameras for the above purposes. The images and sound recorded by the CCTV cameras are also considered to be Personal Data, whereby the provisions set out in the Majestic Elegance Privacy Notice will also be applicable to them.

IV. Transfer to Third Parties.

The Personal Data can only be passed on to companies belonging to the Majestic group, whether in this country or abroad, and to third-party providers of services with whom Majestic Elegance has contracts in place for providing services to its guests, in accordance with the purposes and terms set out in this Privacy Notice.

By consenting to the processing and transfer of your Personal Data, you are therefore also authorising the transfer of that information (including the Credit Card information provided) to such third parties, for payment of the services and/or products requested.

V. Mechanisms for: (i) Requesting access to Personal Data, (ii) Limiting the Use and Disclosure of Personal Data, (iii) Exercising your ARCO rights (Access, Rectification, Cancellation or Opposition) or (iv) Revoking your Consent to the Processing of Personal Data.

You are informed that, in order to state, at any time: (i) your request for access to your Personal Data, or (ii) to limit the use and disclosure of your Personal Data, or (iii) exercise your ARCO rights (access, rectification, cancellation or opposition), or (iv) to revoke your consent to the processing of your Personal Data, you have to submit a formal request to that effect, in writing and duly signed, to the Personal Data Protection Department, at the address and contact information of indicated at the beginning of this Privacy Notice. Regardless of the motive related to the issues listed above (the “Request”), you can send it by email or present it in person at the office of the Personal Data Protection Department; irrespective of how it is submitted, the applicant must be given the respective acknowledgement of receipt.

The Request must contain, at least, the following points:

(i) the name of the data subject, email and address or other medium for sending you the reply to your request;
(ii) the documents substantiating the identity or, if the case, the legal representation granted by the data subject;
(iii) a clear and accurate description of the Personal Data for which you are seeking to exercise any of the rights mentioned above; and
(iv) any other item or document enabling localisation of the Personal Data.

Once the Request is submitted, Majestic Elegance will reply in writing to the email address provided by the applicant within twenty days from the date of reception, to the effect that, where appropriate, it will be implemented within the fifteen days following the date when the reply was notified. In the case of requests for access to Personal Data, first of all accreditation must be provided of the identity of the data subject making the request or his/her legal representative, as the case may be. If that deadline elapses and Majestic Elegance has not replied to your request, you can then begin the procedure for the protection of your ARCO rights with the Federal Institute for Access to Information and Data Protection.

The above deadlines can be extended once only for the same period of time, provided that the circumstances justify.

In the case of stating your refusal to the processing of Personal Data for purposes that are non-essential or did not arise from the relationship with Majestic Elegance, the Request should be sent to the Personal Data Protection Department within 5 calendar days after you gave your consent. If you do not state any refusal to the processing of Personal Data as set out above, you will be understood to have given your consent for the processing of that data.

For any additional information, doubts or clarification of the above, you should contact the Personal Data Protection Department.

VI. Advertising

If you do not wish to receive advertising information from Majestic Elegance, we kindly ask you to notify us in writing, signed, with a copy of your identity document with a photo, sent to the Personal Data Protection Department, and/or you can also apply to the Do Not Call Registry (REPEP) provided for in the Federal Consumer Protection Act.

VII. Acceptance or Refusal of the Processing and Transfer of Personal Data.

By accepting your reservation confirmation, whether in writing or personally, through the Majestic Elegance website or through any electronic medium used by the latter for confirming your reservation, you can give or deny your consent to the processing and transfer of your Personal Data (including the credit card information provided for payment of the services and/or products); this will be subject to the terms set out in this Privacy Notice and applicable legislation in the United Mexican States.

In respect of the above, for the effects of article 8 of the Law, it will be understood that the data subject or his/her representative authorised in the terms of applicable legislation has automatically consented to the processing of their Personal Data if no opposition has been expressed after this Privacy Notice is made available to them.

Notwithstanding the above, in accordance with the provisions of articles 10, 37 and other relative applicable articles of the Law and its Regulations, Majestic Elegance will be released from the obligations referring to consent for the processing and transfer of Personal Data if:

(i) This is so provided by law.
(ii) The data appears in any source accessible by the public.
(iii) The personal data is subject to a prior disassociation procedure.
(iv) The purpose is to comply with obligations arising from a legal relationship between the data subject and the data controller.
(v) A state of emergency arises that could be potentially damaging to an individual personally or to his/her assets.
(vi) It is essential for medical attention, prevention, diagnosis, the provision of healthcare, medical treatment or management of medical services, if the data subject is not in a condition to be able to give their consent in the terms set out in the General Health Act and other applicable legislation, and such data processing is handled by a person subject to professional secrecy or equivalent obligation.
(vii) A ruling is made by a competent authority.
(viii) If the transfer is necessary for the recognition, exercise or defence of any rights in a lawsuit.
(ix) If the transfer is necessary for the continuance or fulfilment of a legal relationship between the data subject and the data controller.

VIII. Personal Data Protection Measures

Majestic Elegance has implemented the security, administrative, technical and physical measures as necessary and sufficient for protecting Personal Data from damage, loss, alteration, destruction, use, or unauthorised access or processing. Personal Data is protected in databases and computing equipment provided with the necessary security for preventing data leaks.

Physical and logical access control systems, intrusion prevention system, anti-virus scanning and web filtering are some of the tools used for maintaining data security; we also have an internal personal data security policy which is explained to employees and is supervised constantly by the Personal Data Protection Department.

Through the use of the Majestic Elegance website you are informed that cookies and/or web beacons are used to gather the information indicated below:
